Terms of Use

Last updated: September 21, 2026

1. Acceptance of Terms

By accessing or using the NJ Health Now website at https://njhealthnow.com or any of our telehealth services (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use our Services.

These Terms constitute a legally binding agreement between you and NJ Health Now. We reserve the right to modify these Terms at any time. Continued use of our Services after any modifications constitutes your acceptance of the updated Terms.

2. Eligibility

To use our Services, you must:

  • Be at least 18 years of age
  • Be physically located in one of our licensed service states at the time of your telehealth visit: Arkansas, Colorado, Arizona, Florida, Washington, or Texas
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from receiving our Services under applicable law

Certain services — including prescriptions for controlled substances — are available only to patients physically located in Arkansas at the time of service, in accordance with applicable federal and state law.

3. Nature of Telehealth Services

NJ Health Now provides telehealth consultations conducted by licensed nurse practitioners. Our Services are intended to supplement, not replace, in-person medical care. By using our Services, you acknowledge and agree that:

  • Telehealth has inherent limitations compared to in-person care, including limitations on physical examination
  • Our providers may determine that your condition requires in-person evaluation and may decline to provide treatment via telehealth
  • We do not provide emergency medical services. In the event of a medical emergency, call 911 or go to your nearest emergency room immediately
  • Establishing a provider-patient relationship through our platform does not guarantee ongoing care or prescription refills
  • Certain in-person services (IV Therapy, Wellness Shots, Aesthetics) are available only at our Benton, Arkansas location

4. User Responsibilities

When using our Services, you agree to:

  • Provide accurate, complete, and current information about yourself and your health
  • Not misrepresent your identity, location, or medical history
  • Use the Services only for lawful purposes and in accordance with these Terms
  • Not attempt to obtain prescriptions through fraudulent means
  • Not use the Services to harass, threaten, or harm our providers or staff
  • Maintain the confidentiality of any account credentials and notify us immediately of any unauthorised access
  • Comply with all applicable laws and regulations in your state of residence

5. Appointments and Cancellations

Appointments are scheduled through our booking platform at booknjhealthnow.janeapp.com. Please review the cancellation and rescheduling policies displayed during booking. Repeated no-shows or late cancellations may result in suspension of access to our Services.

6. Payments and Fees

Payment is due at the time of service. We accept major credit and debit cards. Financing options may be available through Cherry and CareCredit. All fees are disclosed prior to your appointment. We do not bill insurance directly; however, we can provide documentation to support out-of-network reimbursement claims where applicable.

All sales are final unless otherwise required by applicable law. Refund requests must be submitted within 7 days of service to [email protected].

7. Intellectual Property

All content on this website — including text, graphics, logos, images, and software — is the property of NJ Health Now or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this site without our prior written consent.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Medical information provided through our Services is for informational purposes only and does not constitute a diagnosis or treatment recommendation for any specific individual. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NJ HEALTH NOW, ITS OFFICERS, DIRECTORS, EMPLOYEES, PROVIDERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless NJ Health Now and its officers, directors, employees, providers, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any rights of another person or entity.

11. Third-Party Links

Our website may contain links to third-party websites, including our booking platform (Jane App), financing partners (Cherry, CareCredit), and directory listings. These links are provided for your convenience only. We have no control over the content of those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Arkansas, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Services shall first be subject to good-faith negotiation. If not resolved within 30 days, disputes shall be resolved by binding arbitration in Saline County, Arkansas, under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

You waive any right to participate in a class action lawsuit or class-wide arbitration against NJ Health Now.

13. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, all provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
